INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA / KLAUZULA INFORMACYJNA O PRZETWARZANIU DANYCH OSOBOWYCH - AC Nielsen Polska

In accordance with Article 13 of Regulation 2016/679 of the European Parliament and the European Council of 27 April 2016 on the protection of individuals with regard to the processing of their personal data and on the free movement of such data and repealing Directive 95/46/EC (Data Protection Directive), hereinafter referred to as “GDPR", we inform you that the controller of your personal data is ACNielsen Polska sp. z o.o. with its registered office in Warsaw (postcode: 00-189) at Inflancka 4B, hereinafter referred to as the "Controller". If you have any questions concerning the method and scope of processing your personal data or your relevant rights, please contact us at privacy.department@nielsen.com or in a letter sent to the registered office addresses specified above.

I. Objectives and basis of processing.

Your personal data may be processed to the extent necessary:

  1. to enable you to receive the requested material, including reports and studies prepared by the Controller or its business partners, on the basis of Article 6(1)(b) of the GDPR;
  2. to take steps to conclude or perform a contract, including providing information or making an offer, pursuant to Article 6(1)(b) of the GDPR;
  3. for the purposes of archiving (storing evidence) which are the fulfilment of the Controller’s justified and legitimate interest in securing information in the event of a need to prove facts, pursuant to Article 6(1)(f) of the GDPR;
  4. to conduct customer satisfaction survey(s) which is the realisation of the Controller’s justified and legitimate interest, pursuant to Article 6(1)(f) of the GDPR;
  5. to offer products and services directly (direct marketing), including selection of products and services according to the customers’ needs, which is the Controller’s justified and legitimate interest, pursuant to Article 6(1)(f) of the GDPR.

 II. Data subjects' rights.

Pursuant to Articles 15-22 of the GDPR, you have the right to demand from the Controller:

  1. to access to your data and receive a copy thereof;
  2. to demand to correct (amend) or complete the data;
  3. to demand to erase the data (“the right to be forgotten”);
  4. to demand the restriction of data processing;
  5. to object to data processing, including for marketing purposes;
  6. to demand to transfer the data to another controller.

You also have the right to file a complaint with the President of the Personal Data Protection Office.

 III. Data retention period.

  1. The Controller shall process the data on the basis of your consent until this consent is withdrawn or until it is established that the personal data are out of date.
  2. The Controller shall process the data for the purposes of direct marketing of products and services until it receives an objection to do so or until it is established that the data are out of date.
  3. The Controller may process other categories of data for the period specified by law or for the exercise of legitimate interests, until the statute of limitations on all claims related to the offered products and services.

 IV. Data recipients.

Depending on the purpose and context of the processing, your personal data may be transferred to the Controller’s employees, associates, subcontractors (including processors) and other entities having access to the personal data under the law. Your personal data will not be transferred to third countries outside the European Economic Area.

 V. Automated individual decision-making.

The Controller shall not make any automated decisions on the basis of the collected personal data (within the meaning of Article 22 of the GDPR).

 VIInformation on the voluntary sharing of the data.

Your provision of the personal data is voluntary – however, it is necessary for us to send the materials you have ordered to you, to respond to your enquiry, to submit an offer, or to fulfil another purpose related to the conclusion or performance of the contract/agreement.

 VII. Consent and withdrawal of consent.

To the extent that the processing of the personal data is based on the premise of your consent, you have the right to withdraw your consent to the processing of your personal data, including your consent to its processing for marketing purposes. The withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its with drawal.




Zgodnie z art. 13 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (dalej „RODO”) informujemy, że administratorem Państwa danych osobowych jest ACNielsen Polska sp. z o.o. z siedzibą w Warszawie (00-189), ul. Inflancka 4B zwana dalej „Administratorem”. Jeśli mają Państwo pytania dotyczące sposobu i zakresu przetwarzania Państwa danych osobowych lub  przysługujących uprawnień, prosimy o kontakt pod adresem privacy.department@nielsen.com lub pisemnie na adresy siedziby wskazany powyżej.


I. Cele i podstawy przetwarzania.

Państwa dane osobowe mogą być przetwarzane w niezbędnym zakresie:

  1. w celu umożliwienia Państwu otrzymania zamawianych materiałów, w tym raportów i opracowań przygotowanych przez Administratora lub jego partnerów biznesowych, na podstawie art. 6 ust. 1 lit. b RODO;
  2. w celu podjęcia czynności zmierzających do zawarcia lub wykonania umowy, w tym udzielenia informacji lub przedstawienia oferty, na podstawie art. 6 ust. 1 lit. b RODO;
  3. w celach archiwalnych (dowodowych), będących realizacją prawnie uzasadnionego interesu Administratora zabezpieczenia informacji na wypadek konieczności wykazania faktów, na podstawie art. 6 ust. 1 lit. f RODO;
  4. w celu badania satysfakcji Klientów, będącego realizacją prawnie uzasadnionego interesu Administratora, na podstawie art. 6 ust. 1 lit. f RODO;
  5. w celu oferowania przez produktów i usług bezpośrednio (marketing bezpośredni), w tym dobierania ich pod kątem Państwa potrzeb, będącego realizacją prawnie uzasadnionego Administratora, na podstawie art. 6 ust. 1 lit. f RODO.

 II. Prawa osób, których dane dotyczą.

Zgodnie z art. 15-22 RODO, przysługuje Państwu prawo żądania od Administratora:

  1. dostępu do danych oraz otrzymania ich kopii;
  2. żądania sprostowania (poprawiania) lub uzupełnienia danych;
  3. żądania usunięcia danych („prawa do zapomnienia”);
  4. żądania ograniczenia przetwarzania danych;
  5. wniesienia sprzeciwu wobec przetwarzania danych, w tym w celach marketingowych;
  6. żądania przeniesienia danych do innego administratora;

Przysługuje Państwu także prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

 III. Okres przechowywania danych.

  1. Dane przetwarzane na podstawie Państwa zgody Administrator przetwarza do czasu wycofania zgody lub ustalenia, że dane są nieaktualne.
  2. Dane przetwarzane dla potrzeb marketingu bezpośredniego produktów i usług Administrator przetwarza do czasu otrzymania sprzeciwu względem ich przetwarzania w tym celu lub ustalenia, że dane są nieaktualne.
  3. Administrator może przetwarzać pozostałe kategorie danych przez okres przewidziany przepisami prawa lub z uwagi na realizowanie prawnie uzasadnionych interesów, do czasu przedawnienia wszelkich roszczeń związanych z oferowanymi produktami i usługami.

 IV. Odbiorcy danych.

W zależności od celu i kontekstu przetwarzania, Państwa dane osobowe mogą zostać przekazane pracownikom, współpracownikom, podwykonawcom (w tym Podmiotom przetwarzającym) Administratora oraz podmiotom, mającym dostęp do danych osobowych na podstawie przepisów prawa. Państwa dane osobowe nie będą przekazywane do państw trzecich, nienależących do Europejskiego Obszaru Gospodarczego.

 V. Zautomatyzowane podejmowanie decyzji.

Administrator nie podejmuje na podstawie zbieranych danych osobowych decyzji w sposób zautomatyzowany (w rozumieniu art. 22 RODO).

 VI. Informacja o dobrowolności podania danych.

Podanie przez Państwa danych osobowych jest dobrowolne, ale niezbędne do przesłania do Państwa zamówionych materiałów, udzielenia odpowiedzi na zapytanie, przedstawienia oferty lub do wykonania innego celu związanego z zawarciem lub realizacją umowy.

 VII. Zgoda oraz informacja o możliwości wycofania zgody.

W zakresie, w jakim przetwarzanie danych osobowych następuje w oparciu o przesłankę wyrażonej zgody, przysługuje Państwu prawo do wycofania zgody na przetwarzanie danych osobowych, w tym zgody na przetwarzanie ich w celach marketingowych. Cofnięcie zgody nie wpływa na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem.
